Virginia
process serving is governed by the Code of Virginia (§ 8.01-296). Service can be performed by the local sheriff's office or by an authorized private process server. It must be completed within 1 year of filing the lawsuit.
- Personal Service: Handing the documents directly to the named defendant in person.
- Substituted Service: If the defendant is unavailable, leaving a copy of the papers with a family member who is aged 16 or older at the defendant's usual place of abode, provided they are informed of the document's purpose.
- Posting (Nail and Mail): If personal or substituted service fails, documents can be posted at the main entrance of the defendant's residence. A copy must also be mailed to the defendant at least 10 days before a default judgment is entered
West Virginia,
process serving is governed by Rule 4 of the West Virginia Rules of Civil Procedure. Process servers are not required to be licensed, but they must be at least 18 years old and strictly cannot be a party to the lawsuit or the attorney representing a party
North Carolina,
process serving is governed by Rule 4 of the North Carolina Rules of Civil Procedure. It regulates who can serve documents, how service is completed, and the timeframe for delivery. [1, 2]
Key Requirements & Rules
- Who Can Serve: North Carolina does not require process servers to be licensed. Service must initially be attempted by the county Sheriff. However, if the Sheriff is unable to complete service or neglects to do it, a private citizen can serve the documents.
- Qualifications: A private process server must be at least 21 years old, not a party to the lawsuit, and not related to any party by blood or marriage.
- Timeframe: Service must be completed within 30 days of the summons being issued. [1, 2, 3, 4, 5, 6]
Methods of Service
- Personal Delivery: Handing the summons and complaint directly to the defendant.
- Substituted Service (Sub-Service): Leaving the documents at the defendant’s dwelling or usual place of abode with a person of suitable age and discretion who also resides there.
- Certified Mail: Mailing the documents to the defendant, provided the delivery is restricted and a return receipt is requested.
- Service by Publication: If the defendant cannot be found using reasonable diligence, a notice can be published in a local newspaper in the county where the action is pending.
